CILB provides clarification that a GC cannot
install an Interactive Water Feature

REGULATIONS UPDATE
As previously reported, on September 12, the Construction Industry
Licensing Board (CILB) heard a petition for declaratory statement addressing
Interactive Water Features (IWF), commonly referred to as “splash pads” or
“splash parks.” It had come to the attention of the Florida Swimming Pool
Association that there were areas across the state where a general contractor
was not only pulling the permit for such work, but completing such work.
FSPA’s position was that although a general contractor can pull the permit for
such work, an IWF is clearly a type of public swimming pool and requires the
knowledge and expertise of a licensed commercial pool contractor. Therefore,
a general contractor should be required to sub out this work.
The CILB provided the following clarification: A licensed general contractor
(GC) cannot do the entire work required to install an IWF. Therefore, he must
sub out this work. However, the CILB did not address what type of contractor
the GC had to sub the work out to. Although the FSPA believes this work
must be subbed out to a commercial pool contractor, there was no official
CILB response as to what type of contractor the GC must use when subbing
out this work. FSPA members can read the official final order from the CILB,
as well as the petition that was submitted in the members-only area of www.
