Association (UPSA) to put forward language that will resolve issues related
to proposed changes to 64E-9, the public pool rule. Specifically, language
would clearly provide that the Department of Health (DOH) has the ability to
inspect existing public pools for items that fall under the building code and that
are considered construction items during their biennial inspections. FSPA,
in conjunction with BOAF and UPSA, have been discussing this issue with
DOH, the governor’s office, and legislators in order to ensure both citizens
and tourists are protected and we look forward to a positive resolution. Look
for more information, as we get closer to the legislative session start date.

HB 87 by Rep. Passidomo
Summary
: This bill addresses construction defect claims by revising the
definition of "completion of building or improvement;” providing additional
requirements for notice of claim; revising requirements for response; providing
that actions making claims for certain previously resolved claims be deemed
frivolous; providing for sanctions for such frivolous claims; revising provisions
relating to production of certain records; providing for sanctions for claims that
were solely fault of claimant or its agents; and providing an exception.
